Divorce And Second Marriage
In NC does a bigamist second marriage become legal upon the death or divorce of the first spouse?
In North Carolina if a person who is marred and never divorced remarries another person does that marriage become legal if the first spouse either dies or instigates a divorce? Or does a new marriage have to be preformed to satisfy the law? What statutes would apply?
Bigamy is illegal, so the “second marriage” is not legal. Whether the wife dies or divorces does not make an illegal marriage legal. You would have to legally marry your spouse.
